 The Atlantic County Prosecutor's Office has established the Alternative Prosecution for Positive Outcomes (“APPO”) Program for individuals who indicate a risk for violence. The program goals include interrupting the cycle of violence and retaliation by partnering younger criminal defendants with community and service providers for a targeted course of conditions that, when fulfilled, may lead to a reduction in sentence and/or dismissal of pending charges.  The Atlantic County Prosecutor's Office has established a Mental Health Diversion Pilot Program for individuals with serious and persistent mental illness where there is a causal link between the defendant’s criminal conduct and their diagnosis. The goal is to identify appropriate individuals with certain indictable charges who agree to comply with supervised treatment in exchange for delayed conviction, contingent upon compliance and monthly court appearances, with cooperative defendants’ sentences to be downgraded or charges to be dismissed without prejudice. This is a prosecutor’s voluntary program and all determinations to review and enroll are solely in the discretion of this agency.

The Frederick County Mental Health Court Program (MHCP) is a special part of the Frederick County District Court. Effective Sept. 4, 2018, a pre-charge alternative to incarceration for individuals with mental illness was initiated by the Harris County District Attorney's Office, in partnership with local law enforcement and The Harris Center for Mental Health and IDD, in regard to those offenders who have committed non-violent, low-level offenses. Initial focus was on trespassers, expanding to additional low-level misdemeanor offenses in May 2019. In the first four years from September 2018 through August 2022, over 6,000 individuals have been diverted pre-charge (no criminal charges) on low-level, non-violent misdemeanor offenses in Harris County, TX. In June 2021, the program was expanded again by the Harris County District Attorney's Office to include a post-charge diversion opportunity, to reach as many eligible individuals as possible.

This program helps U.S. Military veterans who are involved in the criminal justice system. It helps divert generally non-violent offenders from jail by offering substance abuse and mental health treatment over incarceration. Successful graduates in many circumstances are able to have a felony offense dismissed. (This is a regional program started in Spotsylvania and now covers the City of Fredericksburg and the counties of Stafford and King George as well) The Docket has taken cases transferred in from other jurisdictions as well.

This program is a joint effort between the two agencies (Spotsylvania Commonwealth's Attorney's Office and Community Based Probation to give first time offenders a chance to have a criminal charge dismissed. The participant’s matter is generally continued for six (6) months and they must perform 50 hours of community service work through the SLATE probation officer at the jail. The work will consist of trash pickup in Spotsylvania County as the participants are assigned to the Spotsylvania County Litter work crews to perform their hours. Thus, the program is named the SLATE (Spotsylvania Litter and Trash Elimination) Program. It offers the participant a chance to “Wipe their slate clean” of a criminal conviction.

SLATE Program

This program helps divert non-violent offenders from jail by offering substance abuse treatment over incarceration. The
 court helps individuals who have been arrested and who have a substance use disorder. The program includes frequent drug
 testing, substance abuse therapy, and supervision. Successful graduates in many circumstances are able to have a felony
 offense dismissed. (This is a regional program covering the jurisdictions of the City of Fredericksburg and the counties of Spotsylvania, Stafford, and King George.)

The Program diverts defendants with mental illness towards treatment and away from incarceration. Defendants are connected to services and closely supervised to ensure safety and prevent recidivism

The Portage County Diversion Program was created to provide lower-risk first time offenders a voluntary alternative to criminal adjudication by allowing them to fulfill a set of conditions designed to address, treat, or remedy issues specific to their offense and needs. Evidence suggests traditional criminal justice practices can actually increase the likelihood of recidivism by exposing these individuals to higher risk offenders. The Diversion Program limits or eliminates this exposure. Upon successful completion of the conditions, the charges against the defendant are not filed, dismissed, or amended. The program takes into consideration the offender’s charges, risk, and needs before participation is approved. Case management while upholding victims’ rights are driving factors in ensuring restorative justice. The two types of agreements that are offered are Deferred Prosecution Agreements (DPA) and Deferred Entry of Judgments (DEJ).

Drug courts use a collaborative approach to treatment involving defense attorneys, prosecutors, treatment and education providers, and law enforcement officials. Non-violent offenders voluntarily enter the program in which rules are clearly defined and a contract between the offender, attorneys, the District Attorney and the court is signed.

Erie County District Attorney Office

Buffalo City Court created the first VTC in 2008. VTCs (known as Veterans Court or Veterans Track in some jurisdictions) address these challenges in a forum that is helpful to veterans’ rehabilitation. Where available, VTCs work with civilian healthcare providers, local veterans service agencies, the New York State Division of Veterans’ Services and the U.S. Department of Veteran Affairs. They utilize veteran mentors and mental health specialists to complement probation services and incorporate a therapeutic approach to afford veterans opportunities to transition into civilian life and regain stability.
